Terms and Conditions of Use

CHAPTER I – GENERAL PROVISIONS

Article 1 — Subject Matter

1. These Terms and Conditions of Use govern access to, use of and contracting of the services provided by DomusCare Mozambique, as well as the rights, duties and responsibilities of the company, clients, users, employees, service providers and all other parties involved.

2. These Terms form an integral part of all contracts entered into between DomusCare and its clients, unless otherwise agreed in writing.

3. By requesting, contracting or using any service provided by DomusCare, the Client declares that they have read, understood and fully accept these Terms, as well as the company's other internal policies.

Article 2 — Legal Basis

These Terms are drawn up in accordance with the legislation of the Republic of Mozambique, namely:

  • Constitution of the Republic of Mozambique;
  • Civil Code;
  • Commercial Code;
  • Consumer Protection Law;
  • Labour Law;
  • Penal Code;
  • applicable tax legislation;
  • legislation on electronic commerce, data protection and other applicable rules.

Whenever the legislation is amended, these Terms will be deemed automatically adapted to the mandatory provisions in force.

Article 3 — Definitions

For the purposes of these Terms, the following shall mean:

  • DomusCareCompany responsible for organising, coordinating, managing and providing the services.
  • ClientIndividual or legal entity that requests or contracts a service.
  • UserAny person who uses the website, mobile application or other official DomusCare channels.
  • Service ProviderPerson authorised by DomusCare to perform services on behalf of the company.
  • ServiceAny activity made available by DomusCare.
  • PlatformDigital system, website, mobile application or other electronic means used to manage the services.

CHAPTER II – SERVICES

Article 4 — Services Provided

DomusCare provides home and business services, including, among others:

  • Domestic cleaning;
  • Deep cleaning;
  • Post-construction cleaning;
  • Office cleaning;
  • Sanitising of sofas, mattresses, carpets and upholstery;
  • Babysitting;
  • Post-natal assistance;
  • In-home care for the elderly;
  • Support for people with reduced mobility;
  • Space organisation;
  • Moves;
  • Furniture assembly and disassembly;
  • Shopping and deliveries;
  • Pet walking;
  • Pest control;
  • Other services provided by the company.

DomusCare may add, change or remove services whenever it deems necessary.

CHAPTER III – CONTRACTING

Article 5 — Eligibility

The following may contract services:

  • a) Persons aged eighteen or over;
  • b) Legally constituted companies;
  • c) Legally authorised representatives.

DomusCare may request identification documents whenever it deems necessary.

Article 6 — Service Request

Requests may be made through the company's official channels.

Submitting a request does not oblige DomusCare to accept it.

The service is considered confirmed only after:

  • confirmation of availability;
  • validation of the information provided;
  • express acceptance by DomusCare;
  • confirmation of payment, when required.

Article 7 — Quotes

Quotes are valid only for the period indicated.

DomusCare may review prices when:

  • there are changes to the requested service;
  • incorrect information is provided;
  • unforeseen situations arise;
  • additional labour is required;
  • there is a significant increase in operating costs.

Any change will be communicated to the Client in advance.

CHAPTER IV – PAYMENTS

Article 8 — Payment Methods

Payments may be made through:

  • M-Pesa;
  • e-Mola;
  • Mkesh;
  • Bank transfer;
  • Bank deposit;
  • Bank card;
  • Other means made available by DomusCare.

All payments must be made in Meticais (MZN), unless otherwise agreed in writing.

Article 9 — Default

Late payment may result in:

  • suspension of the service;
  • cancellation of the booking;
  • collection of legally admissible charges;
  • recourse to the judicial mechanisms provided for in Mozambican law.

CHAPTER V – CANCELLATION

Article 10 — Cancellations

The Client may cancel or reschedule the service in accordance with the deadlines set out in the Cancellation Policy.

Cancellations made outside the established deadlines may result in:

  • an administrative fee;
  • travel costs;
  • partial or full payment for the service, when expenses have already been incurred.

CHAPTER VI – RESPONSIBILITIES

Article 11 — DomusCare's Responsibilities

DomusCare undertakes to:

  • provide services professionally;
  • select qualified professionals;
  • protect clients' privacy;
  • maintain high quality standards;
  • respond to complaints impartially;
  • fully comply with Mozambican legislation.

Article 12 — Client's Responsibilities

The Client undertakes to:

  • provide truthful information;
  • guarantee access to the service location;
  • ensure minimum safety conditions;
  • inform in advance of existing risks;
  • treat professionals with respect;
  • make payments within the agreed deadlines.

Article 13 — Limitation of Liability

DomusCare's liability is limited to damages proven to result from intent or negligence of the company or its employees.

The company will not be liable for:

  • false information provided by the Client;
  • defects existing before the service was provided;
  • normal wear and tear of goods;
  • damage caused by third parties;
  • force majeure events;
  • power outages;
  • failures in telecommunications networks;
  • floods, cyclones, storms or other natural disasters;
  • situations of social instability or orders from the competent authorities.

CHAPTER VII – CONDUCT

Article 14

Any conduct constituting the following is prohibited:

  • violence;
  • harassment;
  • discrimination;
  • intimidation;
  • corruption;
  • attempted bribery;
  • offensive language;
  • consumption of alcohol or drugs during the service.

Violation of these rules may lead to the immediate interruption of the service and the application of the disciplinary measures provided for in the internal policies.

CHAPTER VIII – DATA PROTECTION

Article 15

Personal data will be processed only for:

  • contract management;
  • invoicing;
  • communication with the Client;
  • provision of services;
  • compliance with legal obligations.

DomusCare undertakes to adopt appropriate technical and organisational measures to ensure the security of clients' personal information.

CHAPTER IX – INTELLECTUAL PROPERTY

Article 16

All of DomusCare's visual identity, including:

  • brand;
  • logos;
  • website;
  • application;
  • photographs;
  • videos;
  • documents;
  • content;

constitutes the exclusive property of the company.

Any reproduction without written authorisation is prohibited.

CHAPTER X – DISPUTE RESOLUTION

Article 17

The parties undertake to seek to resolve any conflict through amicable negotiation.

If no agreement is reached, the dispute will be submitted to the competent courts of the Republic of Mozambique, in accordance with the legislation in force.

CHAPTER XI – FINAL PROVISIONS

Article 18

The nullity of any provision of these Terms does not affect the validity of the remaining clauses.

Article 19

DomusCare reserves the right to amend these Terms whenever necessary to ensure compliance with the legislation or to improve its services.

Article 20

By contracting any DomusCare service, the Client declares that they:

  • have read these Terms in full;
  • understood all the clauses;
  • freely accept all the conditions established herein;
  • undertake to comply with the company's internal policies.
